Terms of Use

1. Scope and provider

These terms govern your use of the YAIP apps for iPhone, iPad, Apple TV, Android, Android TV, Samsung and LG TVs, Windows, macOS and Linux, the YAIP web app and YAIP Sync (together, "YAIP"). YAIP is provided by Ismail Cherri, 12167 Berlin, Germany ("we", "us"). Contact: our contact form. Details are in the imprint.

You are a consumer if you use YAIP for purposes that are mainly outside your trade, business or profession. Mandatory consumer protection rules of the country where you live continue to apply.

2. What YAIP is

YAIP is a media player for services that use the Xtream Codes interface. It lets you add a service you already have access to, browse its live channels, guide, movies and series, and play them. Optional features include profiles, downloads for offline viewing on phones and tablets, and YAIP Sync between your devices.

3. Your content and acceptable use

YAIP does not include, provide, sell, host or link to any channels, movies, series, playlists or other content, and we have no affiliation with any provider. All content you play comes from the service you add yourself. We do not check, endorse or take responsibility for it.

Every YAIP app shows this as a short statement ("YAIP is a player only") when you first open it on a device, and you accept it before you continue. You can read it again at any time under About on the profile screen.

You agree:

• to use YAIP only with services and content you are legally entitled to access and watch;
• not to use YAIP to infringe copyright or other rights, or to circumvent technical protection or access controls;
• to comply with the terms of your provider, including limits on the number of devices;
• not to interfere with YAIP, our servers or the relay of the web app, for example by overloading them, probing them for vulnerabilities or using them for anything other than playing your own service in YAIP.

You are solely responsible for the services you add and the content you play. If we learn that YAIP Sync or the web app is used for clearly unlawful purposes, we may suspend the account concerned.

4. Licence

We grant you a non-exclusive, non-transferable licence to install and use YAIP on devices you own or control, for your personal, non-commercial use, in line with these terms and the rules of the store you downloaded it from. You may not copy, modify, resell or reverse engineer YAIP except where the law allows it. YAIP, its name, icon and design remain our property. Third-party components are licensed under their own terms.

5. YAIP Sync account

YAIP Sync is optional. You sign in with an email address you control, using one-time codes. Keep your email account and sync passphrase secure: anyone with access to them can access your synced data. We cannot recover a lost passphrase, because we never receive it; you can erase your synced data and set a new one. You can delete your account at any time (see Delete your account). The web app only works with an existing account.

6. Price

YAIP is free of charge on every platform. There is no trial, subscription or in-app purchase, and we do not ask for payment details. YAIP does not include any content or any service from a provider; what you pay your provider is between you and them.

We may offer optional paid features in the future, for example for YAIP Sync. If we do, we will tell you in advance, show the price before you buy and publish the terms for it. Nothing is ever charged without your explicit purchase.

7. Updates and availability

We will provide updates needed to keep YAIP in conformity with the contract, as required by law, for as long as you can reasonably expect. We may also improve or change features, and we will tell you about relevant changes in advance. YAIP Sync and the web app are online services: we aim to keep them available but cannot guarantee that they are always uninterrupted. YAIP's playback features work without them. How well a stream plays depends on your provider, your network and your device, which we do not control.

8. Warranty

For consumers, the statutory warranty rights for digital products apply (in Germany, §§ 327 et seq. of the German Civil Code, BGB). If YAIP does not work as described, please contact us first so we can fix it.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence, we are only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely), limited to the damage typical and foreseeable for this type of contract. Otherwise our liability for slight negligence is excluded. YAIP is provided free of charge; to the extent the law treats it as a gift, we are only liable for intent, gross negligence and fraudulently concealed defects. We are not responsible for content or services of providers you add to YAIP.

10. Termination

You may stop using YAIP and delete your account at any time. We may suspend or close a YAIP account for a serious breach of section 3, after a warning unless that is unreasonable. If we ever stop offering YAIP Sync, we will tell you at least 3 months in advance.

11. App store terms

If you downloaded YAIP from the App Store, Apple's Licensed Application End User License Agreement also applies, and the following applies in addition: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support for YAIP; to the extent permitted by law, Apple has no other warranty obligation with respect to YAIP; Apple is not responsible for any claims relating to YAIP or your use of it; Apple is not responsible for third-party intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. The terms of Google Play, Samsung and LG also apply to apps downloaded from their stores.

12. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of the country where you live.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Please contact us first: most problems can be solved through the contact form.

13. Changes to these terms

We may change these terms for valid reasons, such as new features, changes in the law or in store rules. We will tell you about changes affecting you at least 30 days before they apply, in the app or by email. If you do not object before then, the new terms apply; we will point this out in the notice. If you object, you may stop using YAIP Sync.
